REVENUE MEMORANDUM CIRCULAR NO. 95-2025 issued on October 27, 2025 circularizes Republic Act No. 12235 titled “An Act Amending Sections 134 and 168 of Republic Act No. 8424, Otherwise Known as the National Internal Revenue Code of 1997, as Amended”, including the Veto Message of President Ferdinand R. Marcos, Jr.

Section 134 of the National Internal Revenue Code (NIRC) of 1997, as amended, is amended to read as follows:

“Section 134. Denatured Alcohol. – Ethyl alcohol of not less than one hundred eighty degrees (180°) proof (ninety percent (90%) alcohol by volume), whether imported or locally manufactured, shall, when suitably denatured under Section 168 of this Code and rendered unfit for oral intake, be exempt from the excise tax, prescribed in Section 141: Provided, however, That such alcohol shall be subject to tax under Section 106(A) of this Code: Provided, further, That if such alcohol is to be used for motive power, it shall be taxed under Section 148(d) of this Code: Provided, finally, That any alcohol, previously rendered unfit for oral intake after denaturing but subsequently rendered fit for oral intake after undergoing further processing shall be taxed under Section 141 of this Code and such tax shall be paid by the person in possession of such reprocessed spirits.”

Section 168 of the NIRC of 1997, as amended, is amended to read as follows:

“Section 168. Denaturing Within the Philippines. – For purposes of this Title, the process of denaturing alcohol of not less than one hundred eighty degrees (180°) proof (ninety percent (90%) alcohol by volume) in the Philippines shall be effected prior to removal from the premises of duly registered distilleries, and compounding plants where the rectifying facilities are located: Provided, That the denaturing process shall be done in accordance with the rules and regulations to be issued by the BIR which shall include the denaturant formulations to be used: Provided, further, That the BIR shall require a confirmatory testing prior to the removal of the denatured alcohol: Provided, finally, That the BIR shall designate BIR representatives to monitor the denaturing process.”
