REVENUE MEMORANDUM CIRCULAR NO. 53-2004  issued on August 13, 2004 clarifies whether minors who are opening a bank account can be issued a Taxpayer Identification Number (TIN).
           
Per reply of the Bureau’s Legal Division on the said query, it was cited that under Article 37 of the New Civil Code, minors do not have juridical capacity and thus, are not capable of entering into contractual relations or be the subject of legal relations.
           
Therefore, since the law discourages and disallows minors from managing their own property, the Bureau of Internal Revenue is of the opinion that minors cannot be issued TIN.
