REVENUE MEMORANDUM CIRCULAR NO. 16-2007 issued on March 15, 2007 publishes the full text of OCA Circular No. 05-2007 issued by the Office of the Court Administrator (OCA) of the Supreme Court. Said Circular directs judges and clerks of courts of the Regional Trial Courts to notify the Bureau of Internal Revenue (BIR) through the Commissioner whenever petitions are filed in court involving cases of rehabilitation, insolvency, corporate dissolutions by judicial means and judicial settlements of estates of deceased persons, to enable the BIR to take the necessary actions to protect the interest of the government, which has the first preference in the liquidations thereon.
Whenever such notices from the courts are received by the Bureau and the same are accordingly endorsed to the respective BIR offices, revenue officials and personnel are enjoined to immediately take such actions as may be necessary to ensure that the taxes due from the companies or estates of deceased persons involved in said cases, as the case may be, are claimed in such proceedings by the BIR, asserting the right of first preference of the government in such liquidations.
